Clinton vs. Trump – How the American Constitution is Doomed Either Way

The national election between Trump & Clinton is nearly a half a year away. The vote of the most liberal Democrat counts equally with the vote of the most conservative Republican in society. Your opinion, as is your vote, is really not that special in the grand scheme of geo-politics – which should humble us in our statements. Feel free to validate your existence with a response below.

Many people on the ‘political right’ feel as though the Constitution of the United States is under threat in America, and set out to defend it. Ironic, considering the same group has nominated Donald Trump who promises to violate the Constitution at nearly every speech. “Ban Muslims from entering the United States” – a good old fashion double down from the Trumpster this week after the Orlando shootings.

However, did you know this has already proven to be unconstitutional on the state and local level this year?

Mike Pence, Governor of India once enacted legislation this year to ban all Syrian migrants from entering the immigration system from living in Indiana. He was promptly sued and promptly defeated in the courts – with the courts finding the law unconstitutional. Texas lost the same case in their state courts as well – literally just this week.

Banning an entire religion from the United States is unconstitutional, plain and simple – the courts will even back it up. If elected, this particular policy of Donald Trump will be in clear violation of the First Amendment:

The First Amendment guarantees freedoms concerning religion, expression, assembly, and the right to petition.  It forbids Congress from both promoting one religion over others and also restricting an individual’s religious practices.  It guarantees freedom of expression by prohibiting Congress from restricting the press or the rights of individuals to speak freely.  It also guarantees the right of citizens to assemble peaceably and to petition their government.

The irony of the situation is that 42% of Republicans now claim to support this policy nationwide – per Reuters. So, when you look at it, in 2016, 42% of Republicans are arguing to violate and change the Constitution. Oddly enough, this is the same political group who defends the Constitution as not existing as a living document – which should never be changed. They are opposed to the liberals whom conservatives feel are ‘hell bent’ on destroying it.

To this point, especially after the Orlando Massacre, gun rights – the 2nd Amendment – is once again at the political forefront of the nation. People are taking polarizing stances on both sides of the issue. But when all is said an done, what are we talking about here? This is the language of the 2nd Amendment of the Constitution: “The right of the people to keep and bear Arms, shall not be infringed.

Well, like it or not, it has been infringed upon a lot. Only 9 of 50 states in the country still have Constitutional Carry Laws. With the modern direction of the country, after well over 200 years since the signing of the document, a more popular leftist opinion has been to scrap the Second Amendment altogether. Many people fear with increased actions/protests/demonstrations against gun rights over the course of the last decade particularly, we are on the verge of losing the Amendment in the near future.

Opponents to this logic argue many developed countries already adopted developed gun restriction legislation – quite successfully, they might argue. The U.S. has outgrown this outdated document and the 2nd Amendment. For this reason I argue that Hillary Clinton also proposes to violate the Constitution with her anti-gun rights rhetoric.

So, pick your poison. Would you rather loose the 1st Amendment with Donald Trump of the 2nd Amendment with Clinton? Either way, the Constitution appears to be going down no matter how you look at it, or what side of the isle you stand.

  1. Not to sound like an asshole, but doesn’t the muslim faith require “death to all infidels* (anyone who doesn’t give a flying fuck about muslim/islam and just wants to continue their day as-per-usual)?

    I understand that it would be unconstitutional to ban a religious belief from the US, but at the same time – any religion that demands human death as a form of worship shouldn’t be allowed to exist. Two big examples;

    – Satanism (which a schmuck on the street is kidnapped and murdered)
    – Islam (as I’ve already mentioned as to why)

    I have no doubt that there are probably other cults/practices that need to be wiped off the earth as well. EXAMPLE: In the Bible, it mentions an entire clan of people that would torture and kill their children in worship of a demon (as also mentioned, this culture was so cancerous that God (the jewish/christian deity) ordered a complete and total genocide of it.

    So, yea. Again, not to sound like a fascist nazi-loving idiot, but if we don’t AT THE VERY LEAST keep an eye on extremely radical faiths/beliefs that DEMAND the death of people (whose only fault was not believing in said religion/faith), it will build-up and lead to an inevitable final crusade that will result in the complete and total annihilation of anything related to the belief.

    Sometimes the minority needs to remain as the minority. Think on it guys. Would it make you feel better if our federal government was run by a bunch of furries?

  2. ^This person desperately needs Jesus. Oh my, ha, I jest, all religion is pretty pointless. But hey, go study the Bible a bit; plenty of killing in the name of God, ordered by God; Like that one, uh, what was that about? Oh yeah, it was about a woman cheating on a man… Yeah-yeah-yeah-yeah, right, she’s supposed to be stoned to death for having free will, that’s right, yeeeah. Ahh, wonderful bedtime stories.

  3. Maybe I misunderstand, but the examples you give for Trumps ‘blocking islam’ are all internal. States doing something on their own. The country has the freedom to refuse anyone into the country they feel is a threat. The first amendment only applies to those already in our country. Jimmy Carter put that to use during his presidency. So why is Trump doing it now against the first amendment?

  4. it is time to accept that that the office of the united states president is a trojan horse for a coming tyrant – no matter who or which party holds it. america should adopt a parliamentary constitution that will enable our constitutional republican
    mortal state to protect our liberal democratic mortal society under a multi-party system. the core of that constitution will be a declaration of the rights of the person and the citizen. let the marketplace of ideas bring in new capital: nonviolence,
    avoiding aggression and nonsinning, avoiding harm to others. the govenment that governs the best is the one governs the least. welfare capitalism and leave consenting adults alone with their drugs, guns, books, etc. buddha bless. truce.
