Major Set Back for Trump: Federal Judge Issues a Stay Against “Muslim Ban” Nationwide

As citizens descended on John F. Kennedy Airport (JFK) to protest Donald Trump’s Muslim ban, a federal judge in Brooklyn issued an emergency stay to temporarily allow those who have already landed in the United States with a valid visa to remain. The ruling is being referred to as a “stunning defeat” for Trump at the end of his first week, as it also protects refugees or visa holders who are being detained at American airports from deportation.

IB Times has since reported that judges in Boston “passed an order late Saturday night, saying Customs officials could not detain anyone solely on the basis of the executive order by President Donald Trump that bans citizens from seven Muslim-majority countries from entering the United States.”

Muslim ban

New York Daily News reports that Trump spared the Muslim countries he has business interests in, despite those countries having deep-seated ties to terrorism. Of the seven countries included in Trump’s executive order, “not a single American was killed on U.S. soil by citizens from any of those countries between 1975 and 2015, according to statistics tallied by the conservative-leaning Cato Institute.”

The ruling in Brooklyn came after a lawsuit was filed by the ACLU on behalf of two men who were detained at JFK. ACLU lawyer Cody Wofsy, along with a large group of attorneys, worked through the night on Friday to write the brief that challenged the executive order – Wofsy personally stayed the night at the San Francisco International Airport on Saturday to ensure the individuals detained would not be removed in violation of the judge’s order.

The order was granted by Judge Ann M. Donnelly of the US District Court on a temporary basis. The question of whether it will be made permanent will be determined later by another court.

In a statement from Wofsy:

This executive order runs contrary to really our most fundamental constitutional rights and human values in this country. These individuals, many of whom have green cards and have lived here for many years, can’t just be put on a plane and shipped off.”

55 passengers were either detained or sent back to their native country from at least 6 airports across the nation before the order; and hundreds more around the world were not allowed to board planes headed for the United States. New York City Mayor, Bill de Blasio, provided his support to the protesters at JFK airport, referring to the situation as “shameful.”
