Palm Beach Deputy Behind Bars for Sexually Assaulting Woman on Duty

Another Palm Beach County Florida law enforcement officer has been arrested for sexual misconduct and charged with two counts of sexual battery. Jason Byron Nebergall, a nine year member of the Palm Beach County Sheriff’s Office, has been charged after an investigation showed that he sexually assaulted a woman he encountered on a disturbance call. After a lengthy five months of paid vacation, Nebergall finally had his day in court.

The 38-year-old deputy arrived at the residence of the unnamed victim. According to the woman, he said to her, “You look pretty. You don’t look like you been beat up twice.” After speaking with the woman, he advised he’d be back to check on her – she supposedly had a fight with her landlord. According to the victim, when the officer returned, he “forced himself” onto her. She alleges that Nebergall grabbed her by the hair, pulled her very close and kissed her. He commented on her breasts. He then pressed his genitals against her and asked if she “felt it.” The woman also stated that he pulled out his penis but told her he could not penetrate her without a condom.

Nebergall then left again, telling her he would return to “check on her.” Nebergall was questioned by investigators, but denied that he had any physical contact with her. His story was debunked when traces of his DNA were recovered from her buttocks. The investigation began in July. Nebergall was given the luxury of being on paid vacation for the duration. Over $40,000 worth of tax payer money was spent keeping this monster off the road. The department has been tight-lipped about the details of the investigation, but in a show of closing ranks, Nebergall was booked without a booking photo, with no personal information released on the county booking website.

Nebergall isn’t the only Palm Beach law enforcement officer to be charged with rape. Last year, Boynton Beach police officer Stephen Maiorino was accused of rape and charged with sexual battery. Maiorino drove the victim to a deserted field; forcing her to have sex with him on the hood of his cruiser. Much like other cases involving horrible allegations against law enforcement, the bewildered jury accepted that the sex was consensual and found Maiorino not guilty. Despite the outcome, for two officers in the same county to be accused of the same vile sex crimes, shows that there’s a fundamental problem with law enforcement in Palm Beach County.

The PBCSO released a typical generic statement regarding the incident: The Palm Beach County Sheriff’s Office holds its employees to the highest standards and never forgets about its duty to preserve the public’s trust. Unfortunately sometimes an employee makes a bad decision which leads to misconduct. This misconduct was reported, investigated and subsequently determined to be criminal in nature, resulting in the charges. The sheriff’s office will remain vigilant to insure that our efforts are professional and meet the high standards that the public has come to expect.”
