Police Panic Over Passage Of New Law Authorizing Citizens To Defend Themselves Against Any Aggression In Indiana

48

In recent times, police aggression has become a major concern for many citizens across the United States. Apart from the police’s actions, there is also the case whereby citizens suffer from unscrupulous people breaking into their houses and making away with their possessions.

To prevent these issues and to give citizens some form of security, the State of Indiana has passed a new law in which citizens can now use force when necessary to protect themselves and their property against anybody who endangers their lives and property.

1 2....

According to the law, the state now “recognizes the unique character of a citizen’s home and to ensure that a citizen feels secure in his or her own home against unlawful intrusion by another individual or a public servant”.

Provisions of the law, as passed by Indiana lawmakers, state the following in clear and unambiguous language:

(i) A person is justified in using reasonable force against a public servant if the person reasonably believes the force is necessary to:

(1) Protect the person or a third person from what the person reasonably believes to be the imminent use of unlawful force;

(2) Prevent or terminate the public servant’s unlawful entry of or attack on the person’s dwelling, curtilage, or occupied motor vehicle; or

(3) Prevent or terminate the public servant’s unlawful trespass on or criminal interference with property lawfully in the person’s possession, lawfully in possession of a member of the person’s immediate family, or belonging to a person whose property the person has authority to protect.

For citizens, this is a victory because the situation where police will mistakenly break into their houses, shooting the family dog or killing a family member, will be a thing of the past.

But whereas citizens are relieved and very happy with the law which seeks to guarantee them their security, the police are disappointed. According to a reliable source within the Indiana law enforcement agency, police had lobbied seriously against the passage of the bill, but were unsuccessful.

President of the Jeffersonville Fraternal Order of Police Lodge 100- Joseph Hubbard, was quoted as saying “If I pull over a car and I walk up to it and the guy shoots me, he’s going to say, well, he was trying to illegally enter my property. Somebody is going get away with killing a cop because of this law”.

Another high ranking police officer in the state, Tim Downs, has also reportedly described the law as a “recipe for disaster”, adding that he fears more police officers are going to die as a result of the law.

But many Indiana residents have criticized these comments by the officers, saying instead of them looking at the beneficial aspect of this law—which creates the incentive for police to act responsibly and just—they are simply worried about the irresponsibility and recklessness of their officers.

Activists have also said the main concern of the police should be about making sure that they no longer enforce any immoral laws, many of which have led to the deaths of innocent citizens. They add that many people have lost their pets or property due to the gross negligence of the police.

Independent observers have also said, despite the police seeing the law as an act  against them, in reality, it is going to help law enforcement officials in the state. This is because people will be aware of their limit and will always act responsibly to avoid any unpleasant experience.

    • I think this is a stupid law and I agree , more people will shoot officers and use an excuse of defending themselves . It will lead to more officers deaths and be a big blunder on the jobs being performed by officers . It wouldn’t be such a bad idea if we didn’t have so many punks with a ” fuck the police ” attitude !!! Get law makers …. Give your fuking heads a shake ya fuking idiots !!!!

      • the police are complaining that citizens will now get away with killing cops but the fact is the cops have been doing it for far longer. now cops aren’t going to swagger around thinking themselves above the law and that is a step forward whatever way you look at it.

    • This is a stupid law that is gonna lead to a lot of officers deaths . It’s gonna hinder how they do their jobs and a lot of people will shoot first and claim self defence later . It wouldn’t be a bad idea if we didn’t live in a society with so many punks with a ” fuk the police ” attitude !!! Hey lawmakers of Indiana ……. Give your fuking heads a shake , idiots !!!

      • Since law enforcement officers are drawn from the general population, and have repeatedly shown themselves to be no more ethical nor moral than the general populace. I am certain that the number of citizens using this law as a pretext to kill police would be no greater than the percentage of LEO who use their badge to cover for murder. No?

Therefor i am sure that the number of police killed by citizens will be “insignificant”.

      • If you aren’t doing anything wrong, why would you need to JUST shoot an officer? There is still court of law. However, it is true, officers are getting away with victimization upon citizens all over. They use their force and authority as a tool to be illegal. Not all of our officers, but some do. We don’t need punk criminals wearing badges either. Many rapes, beatings, and unnecessary killings HAVE been by our trusted police and THAT needs to stop.

  1. “If I pull over a car and I walk up to it and the guy shoots me, he’s going to say, well, he was trying to illegally enter my property. Somebody is going get away with killing a cop because of this law”.
Well the police have been getting away with killing innocent people since forever so.. Now you understand what is feels like to be powerless.

    • You do realise that a lot of cops aren’t corrupt and those are the ones who will die because when they feel safe they’ll be shot because the public seeks revenge? Everyone knows it. The public have been powerless till this point and now they’ve been given a power they will surely fail to control. Why have more loss of life? Do you really think people will honestly use this law the ‘right’ way?

      • As with the police there will be instances of misuse. I think police will be more careful. Also, for those “good” cops. If they weren’t standing up for right and helping to end the vale of privacy for the cops that are bad. Well that makes them bad as well. That’s how it works for criminals.

      • Police was formed to protect the public. When it failed and became a thread to the public. Then this is an answer. Going back to WILD WILD WEST.

      • You do realize that a lot of the public isn’t corrupt and are in fact, moral. And we understand that “seeking revenge” is wrong.

      • Here is a popular case. with a good outcome. But he one out of many, whom people where found guilty
This new law helps the citizen.
If anything, this forces the officers to make sure they are at the right place, looking for the right person, with the right approach. Which is what they are supposed to do anyways.

        http://wavy.com/2014/07/15/man-charged-for-shooting-when-cops-went-to-wrong-house/

if you want more cases. just google any main news company with “officer”, “wrong house” and maybe add on “killed”

but i also see the case the officers want to make and I could agree with them more. But this is a law, law abiding citizens need to protect themselves.

and no this is not a straw man nor an ad hominem

      • So tell me why we see so many cops being bad apples and none to change it? Oh, I forgot the one that tries to change it are the “bad apples” in the Blue World? They get fired.

  2. I never thought I’d live to see the day when our President would place targets on our Law Enforcement. MOST are there to serve and protect. I’m more concerned with the thugs on the streets. These thugs have made our cops what they are today. An officer today is met with whiney ass attitude, resistance – oh, and of course, a camera for their 10 minutes of fame. Come back in five years without Law Enforcement. It’s going to be a war zone. Let the party begin.

    • Gracie, the President has absolutely NOTHING to do with this! This is the Governor of the State of Indiana and everyone here in Indiana knows what an absolute idiot he is. You are obviously just another person trying to find blame and fault where there is none on our President. Get your facts straight!

    • This is the State of Indiana not the President. I understand that you made your “standard” response, but you should be more careful.

    • You are kidding me right? The president? This law was passed by the STATE of Indiana, the president had nothing to do with it.

    • This is a State Law not a Federal Law, so wtf are you even talking about the President for? And “Thugs” have been becoming Cops since day one, its nothin new. Just because you have a badge doesnt make u anyones daddy. Just like with any other occupation there are always bad seeds and not all cops are bad but u obviously never dealt with an asshole with a badge before. This law is for the law abiding American Citizen who can legally carry a weapon. This does nothing for criminals at all but put them in more danger because now if they try to break into my house I dont have to see shit in their hands but the sweat dripping from it before I put holes into chests

    • Our President? Did u not read the article. This is a State Law honey. Idc for the pres but dont blame someone that wasnt involved in this process. And just because someone wears a badge does not mean that they too are not a thug. Ive met plenty of thugs with badges. There are bad cops, just as there are bad teachers, bad doctors, and as we all know POLITICIANS. I would like to see how this law pans out myself but I wouldnt mind it in my state. If an intruder breaks into my house or tries to strong-arm me or my loved ones property then we should definitely be able to use deadly force. I guarantee crime rates decrease. This law isnt just for LEO’s but criminals as well. And we all know that some LEO’s are very good criminals.. its what they study

    • Oh for FS, Gracie. President Obama has nothing whatever to do with state law. I’m Canadian, and even I know that! Learn your ignorant self something before shooting off your mouth. Thug policeman are becoming more the norm and people are fed up with it. There is a way to clean it up and that involves hitting them where it hurts. Just like people that don’t commit crimes don’t have anything to worry about the police, so it works both ways in that honest cops don’t have anything to worry about citizens they aren’t busting up, and killing their dogs for no reason. The playing field has been leveled, and the cops will have to put on their thinking caps and get some additional training in proper methods to approach citizens of your country… and by the way, it’s a good precursor to what Canada will need in the future, as well. I for one, am pleased beyond pleased to see government working for the people, as it should be.

    • The President has done no such thing; the Legislature of the State of Indiana enacted this law and the responsibility for it when things go wrong (and they will most definitely go wrong) is on them!

  3. Honestly, I can see this causing more of a problem than anything else. Just means that police officers would have more to worry about. That being said, I’m equally against the police shooting innocent people and the many cases of police brutality.

I think the best solution would be to reform the system as a whole where police are held accountable. Also, police officers should be required to take a psych eval twice a year. All failures should then go before a review board and have them decide what happens. The potential is there for to actual prevent this stuff from happening.

    • The review board needs to be an independent civilian review board. We know what happens when its left to the police to police themselves.

  4. Dear America, your country is terrible and your cops are worse. I have no doubt that most cops are out there just trying to do a good job. However, if a few bad cops get shot in the face for shooting someones dog or serving a warrant on the wrong house and killing someone I say the world will be a better place for it.

    • the issue i see with this is before cops were on edge when doing things because they weren’t sure what was gonna happen. Now with this law in effect i can see them always approaching with guns drawn ready to shoot first and ask questions later. So yes i see a few cops getting killed over this then a whole lot of the people that are so gung ho about it being killed by swat.

Remember the police have military grade weaponry and body armor as well as armored vehicles at their disposal. Most civilians don’t have more than a shotgun and a 9mm-45cal neither of which will defeat soft armor let alone heavy armor. That and as soon as too many police die the feds will get involved declare martial law then the real army comes in takes away your guns (either willingly or from your cold dead hand) and your in a worse place than you just were.

  5. I don’t own a gun but I think that those who do should have the right to protect themselves and their property . I also think that body cameras should be used by every police officer . If cameras are used then officers are much less likely abuse their authority . We have the technology use it .

  6. THIS IS A LAW THAT NEEDS TO BE PASSED IN EVERY STATE TO KEEP POLICE HONEST. AND TO DO THERE JOB THEY WERE HIRED TO DO. NOT TO KILL OUR DOGS AND FAMILY MEMBERS IN A FALSE RAID OR THE WRONG HOUSE COPS LOOK LIKE THE ARMY.THATS BS.ITS TIME WE HAD A RITE TO SAY HAY JUST YOUR A COP DONT ME YOU CAN TREAT ME LIKE SHIT.THIS LAW IS LONG OVER DUE,OTHER STATES NEED TO FOLLOW SUIT.

  7. Americans love their firearms. If America deems it suitable to arm their public then no group should be immune to its consequences. Now that’s the democracy they love to push so much (without actually living by it themselves). 🙂

  8. What about when u get pulled over and the cop don’t like the window up and break it out that is not right so who would not fear for their life,so u can defend urself,,,make them think,,,

    • sounds like a great idea except they ran your plates and radioed to dispatch. You shoot and kill them and drive home. They fail to report back and another unit is dispatched to their last known location and finds them dead. An APB is sent out for you in connection to a cop killing next thing you know swat is breaking down your door in full tactical gear with shields just begging you to even look at them wrong so they can shoot you. Sounds to me like a recipe for a lot more dead civilians since the cops will be even more on edge.

A better solution would be the always on cameras a lot of departments make their officers wear. In areas that use them complaints against police and instances of police brutality etc have gone way down. Hard for a civilian to say a cop did something they didn’t when they are on camera the entire time. On the other side of it hard for a cop to beat someone or kill someone and say it was justified when it wasn’t when the video is always rolling.

  9. Have any of you ever read the police conduct manual, this is already in there!! The cops ignore it, now they will be held accountable. Also Google; Your right of self defense against unlawful arrest. There are dozens of Supreme Court cases where people have defended themselves and the cop was killed and the Citizen justified. This “statutory language” changes nothing.

  10. “If I pull over a car and I walk up to it and the guy shoots me, he’s going to say, well, he was trying to illegally enter my property.”

And if someone says that. then they are going to have to back up that statement in court with evidence. If you have a dashcam and a bodycam and that evidence does not back up the driver’s statement that you were trying to illegally enter his vehicle then he will go to prison for murder.

  11. It is about time. We the people suppose to have the law protect us but the institution and corporate took all the laws on their side leaving us all vulnerable to their power trip.
They apparently forget that they all work for us earning money we pay.
Get off your power trip and give us our rights back!!!
