thefreethoughtproject.com has published a video, in which two police officers systematically subjected an innocent citizen of the United States (US) to gross abuse, despite the man invoking the 5th Amendment right of the US Constitution.
The incident was said to have happened in Atlanta-Georgia, where Dilshod Tulyoganov, was held by a Georgia State Trooper for not coming to a complete stop before making a turn.
The officer, who was later identified as Johnston, demanded that Dilshod produce his identity. Dilshod complied and gave him his driving license.
Not satisfied with the identification, the officer asked Dilshod whether the address on the license was correct and Dilshod knowing his right decided not to respond to the question. Dilshod invoked his 5th Amendment right boldly by stating, “I’d rather not answer”.
But the officer replied “you don’t have a choice but to answer”. It is unclear whether the officer was just acting out of ignorance, or he knew the law but thought that the right to remain silent does not apply in that instance.
“I flexed my rights and he ignored it. Because I didn’t kiss his boots he humiliated me in front of people,” Dilshod explained in an interview.
Dilshod knew the Supreme Court of the United States ruling in Salinas v. Texas, in which you are now expected to know that you have a right against self-incrimination, and unless you specifically and clearly invoke this right, anything you say or do not say, including your mannerisms at the time you stop talking, can be used against you. You actually have to say, “I do not answer questions”.
Don’t concern yourself with what kind of interrogation you’re in. Don’t worry about whether Salina’s case applies in your particular situation. Just invoke your 5th Amendment right immediately, verbally, and clearly. That is exactly what Dilshod did.
The officer, probably knowing that Dilshod knew his rights, then said that he stopped him for not coming to a complete stop when he came off of the interstate. The officer then went back to his unit to write a ticket for Dilshod.
Few minutes later, the officer returned to the vehicle and demanded that Dilshod get out of his car, but Dilshod replied he’d rather stay in the car, to which Johnston replied, “You don’t have a choice,” and pulled open the door to forcefully get him out of the car. Dilshod had requested for a supervisor, it was while the two were waiting for the supervisor to arrive that the officer decided to use force against Dilshod.
“I don’t think you understand, this is my traffic stop…..all you had to do is do what I ask,” the officer said, becoming more aggressive towards Dilshod.
The officer forcefully opened the door and got hold of Dilshod, handcuffed him like a criminal and continued his abuse against the innocent man, who had invoked his right from the Constitution.
As the officer continued to struggle with Dilshod the supervisor arrived and immediately, without even asking to know the facts of the matter, jumped in to side with the officer.
“If you have nothing to hide…let’s throw all the legal mumbo jumbo out the window sir. Let’s play on big boy terms. Let’s not play the lawyer game and ‘my rights are violated’ game or none of that bullcrap today,” the supervisor told Dilshod.
Yes, you heard him. That is the manner in which a supervisor spoke to a member of the general public, despite the fact he has been paid to protect civilians. That is how bad law enforcement has gotten in the US. Somebody who is supposed to know better and even educate people on the law, is calling an enshrined Constitutional right mumbo jumbo, stating that it should be thrown out of the window.
It is sad. It is disgusting that such a person is being paid with the tax payers’ money. Watch the video and judge for yourself.

This is what happens daily in California and it will continue to escalate because these cops have become above the law. Who’s supposed to police the police
The Young man conductor of the car has an accent and it is more probable that the officer responded in that way. I don´t think he would have treated a blonde blue eyed girl that same way with her father in the car. It is an outrage. Homeland security is pumping up the local pólice brutality by giving them more weapons they can handle. they are giving pólice cars and weapons to local departments
for the violence that everyone is witnessing with the pólice no one knows how to respond to a simple traffic stop. In the old days it was more common to get the ticket and go on your way. It was very strange that he asked the conductor to get out of the car. I have always been told to stay in my car in a traffic stop. It is not getting better. The law enforcement agency and homeland security are working together and are very agressive and anti human. Yet I have met many homeland security officers that are very profesional and helpful and would never behave that way.
I have read articles online where homeland security is funding and donating weapons to local pólice departments but in very large quantities. They also donate vehicles. In the town where I am the rear of a local pólice car announces that it was donated by homeland security. I feel that once we understand the relationship between homeland security and the local pólice departments that we will better understand the pattern of the agressive tactics used by local forces and why. I would like to know if they are also training local departments. I have read that they work together to connect and sieze immigrants that are not american citizens.
Obama is now in my mind a failure to those that elected him. We were occupied with his ACA and it kept us busy. Now with the Wikileaks out it is sure as shooting that he is just a puppet. I cannot believe that it is going down this way.
This individual’s rights were wholly and completely violated, his 1st, 4th, and 5th amendment rights.
