Kelly Thomas, a 37-year-old schizophrenic homeless man, was brutally beaten and killed on the streets of Fullerton, California, by Jay Cicinelli, Manuel Ramos, and Joseph Wolfe of the Fullerton Police Department in July 2011.
Ramos was charged with one count of second-degree murder and one count of involuntary manslaughter. Cicinelli and Wolfe were each charged with one count of felony involuntary manslaughter and one count of excessive force. All three were found not guilty of all charges and were subsequently acquitted in 2014.
Now it has been reported that Cicinelli has for years been receiving a $40,000 annual pension from the city of Los Angeles.
Before becoming an officer at the Fullerton PD, Cicinelli got his start within the ranks of the LAPD. However, when he was shot in the face that cost him his left eye in 1996, just three weeks after graduating from the police academy, Cicinelli agreed to retire early in exchange for around 70% of his annual salary (which came out to $40,000 a year) as part of a disability pension because there was no place for a disabled cop in the LAPD.
Ironically, the man who shot him, Raul Jimenez, ended up being sentenced to life in prison. 15 years later, when Cicinelli killed a homeless, he was let off.
The Los Angeles Times reported in 2011 that agreement didn’t keep Cicinelli away from law enforcement and that “despite his disability, Cicinelli was hired as an officer by the Fullerton Police Department, where he worked his way up from a reserve officer to a corporal earning $88,544 a year”.
Cicinelli continued to cash $40,000 from the city of Los Angeles during the 12-year span he spent with the Fullerton Police Department. His payments continued even though he was fired in 2012.
Now that Cicinelli is acquitted of charges related to Thomas’ death and is interested in rejoining the force, should Cicinelli be reinstated at the original pay he made when he joined the Fullerton PD in the late 1990s, he’d again collect nearly $130,000 a year.
