Police Officers Taser Unarmed New York Man to Death

Two Ballston Spa, New York police officers responded to a call last September that resulted in an altercation with Ballston Spa resident Daniel Satre. The officers called for backup, and additional officers from the Saratoga Sheriff’s Department as well as New York State Troopers arrived on scene. Satre, 43 was unarmed, but visibly agitated. Six officers attempted to physically subdue Satre, and when they were unsuccessful, the officers tasered him repeatedly until he became unresponsive. Satre died on the scene from his injuries.

“At most, he (Satre) was guilty of disorderly conduct on his own front lawn and ended up dead. This needs to be properly investigated by an outside agency,” said Terence Kindlon, attorney for Daniel Satre’s family.
Friends and family are calling for an independent investigation of the incident, and have launched a Change.org petition to New York Attorney General Eric Schneiderman that has garnered nearly 11,000 signatures to date.
“Daniel Satre was a loving father, son, brother, and friend to many. He was a beloved member of the community and a successful business owner. On September 20, outside of his home and unarmed, Daniel was beaten, tasered, and killed by six police officers while four other officers watched,” said Alicia Poulin of Milton Vermont on the petition page. “We never expected to lose him so soon. We could never fathom it would be at the hands of the people we trust to serve and protect. As his family, we are still waiting for justice. There has not been an independent investigation and the officers involved have not been held accountable.”
“(He) was warned several times that officers were preparing to stun him,” said Village Police Chief Charles Koenig in a press conference last fall.
Koenig further stated that the officers involved faced no disciplinary action, but the department would launch its own investigation.
Although an autopsy was completed immediately after the September incident, the results of that autopsy have not yet been released to the public.
Neighbors remembered Satre as never having run-ins with police outside of this, and his family remembers him as a peaceful, loving man.
“The last time I saw him, he was cuddling with his cat and he said, ‘I love you,’”Satre’s daughter Amanda Conant told a local ABC affiliate. “That was the last thing I heard from him. That’s the person he was, you know?”

For the purpose of Section 242, acts under “color of law” include acts not only done by federal, state, or local officials within the their lawful authority, but also acts done beyond the bounds of that official’s lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. It is not necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim.
    The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any.
    TITLE 18, U.S.C., SECTION 242
    Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, … shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnaping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

  2. I am so sorry for the guy, I mean, what did Satre do wrong except being a good, successful guy to his family, friends, and neighbors ? Again, why do all the good people die and let the evil rise ?! This is again, completely unfair, and by the article itself, the police brutality is completely crossing the line . I feel bad about the incident and for those who remember Satre, the “loving father, son, brother, and friend to many.” I may not have met the guy, but by getting to know his personality by who he is in the article, by what the people have mentioned about him, it does break my heart to see somebody getting killed for nothing. R.I.P. Daniel Satre .

  3. Dan was my dad. My family only wants answers. We have been given none. The DA has not even talked to my family. The only time we even saw her was the first morning he died and she pulled up to my Dad’s house which they were searching without a warrant and she ignored my family completely and acted like she was old pals with the officers who did this to my father. My families petition asks for an outside source to investigate. We would like to Attorney General to step in and take over so we get a fair chance at figuring out what happened.     • Amanda, has anyone in your family talked to Michael Bell?? He’s the one that got the law changed in Wisconsin so that the police couldn’t investigate themselves when there’s a citizen death (because they’re liars and scum and buddies with the DA). He also wrote “How to Stop Cop Hunting” which is an excellent article about how to fix law enforcement in this country. His son was killed by police and he sued and won. He used the money to harass the police until they agreed to help him change the law. You should look him up, I bet he’d help you or at least know what to do. I’m friends with him on facebook. Y’all need a damn good lawyer too b/c I’m over this crap.
