Shocking Mistake in Darren Wilson Grand Jury

A broadcast conducted by Lawrence O’Donnell has highlighted the laws that assisted in Darren Wilson’s success against the courts. Just before Wilson testified against his indictment that he shot and killed Michael Brown in cold blood, a statute was handed out to the Grand Jury by Assistant District Attorney Kathy Alizadeh.

The copy of the statute that was handed out to the jury was of a 1979 Missouri Law that had been ruled unconstitutional by the Supreme Court in 1985. As she proceeded to hand out the copy she said “I’m going to pass out to you all, you all are going to receive a copy of a statute. It is section 563.046, and it is, it says law enforcement officers use of force in making an arrest, and it is the law on what is permissible, what force is permissible and when in making an arrest by a police officer.”

What she handed the jury was something that “had not been law in Missouri during her entre legal career,” according to O’Donnell. He continues to highlight how she was telling the Grand Jury “…that it is legal to shoot fleeing suspects simply because they are fleeing…she was making it impossible for Darren Wilson to fail in front of this Grand Jury.”

The portion that was ruled unconstitutional by the United States Supreme Court, says that a police officer is “…justified in the use of such physical force as he or she reasonably believes is immediately necessary to effect the arrest or to prevent the escape from custody.”

In the announcement, O’Donnell makes a valid point that the case of Darren Wilson vs Michael Brown is “…one of the most important cases of police use of deadly force since 1985.”

  1. But it was proven that Michael Brown wasn’t fleeing. He was struggling with the officer for control of his firearm so that makes this whole article invalid.

      • no sof it wasn’t just officer wilsons statement every bullet fired hit brown in the front if he was fleeing like you wish was true he would of been shot in the back, all of the forensic science shows there was a scuffle for the gun.only way the metal residue from the gun (not powder residue) could of gotten on browns thumb is if his thumb was withing 4 inches of the barrel so stop adding your ignorance when you obvbiously don’t have a clue what you are talking about , and no matter how many idiots claim otherwise it still just doesn’t change the facts proven by medical professionals and ballistic experts

    • Wow! Your behind, actually Darren Wilson states he was fleeing but that it is his job to chase and not let him get away. The fact that the prosecutor gave them a false document basically, due to being out dated by over 20 years is very relevant.

      • he fled after he was already shot after Darren tried to shoot him again. That doesnt make right to shoot the fucking guy dead. they dont train you how to aim? he could have shot the legs or used a taser? im sure he couldnt run that fast after already being shot. even if he still could run fast he wouldnt make it far

            They shoot to stop. If the person dies as a result that is a circumstance of the shooting but they do NOT shoot to kill. There is no need to do so once the attack is stopped.

          • I just want to point out that officer wilson was not carrying a taser at the immediate time and as a result of so amd the charges that brown commited that were not in court states that he had just robbed a store or something i cant remember exactly but wilson had either shoot and kill or let him get away. I would also like to point out that yes they are indeed tought shoot to kill i am not an officer myself but have people very close to ne that are.

          • They do NOT train to shoot to stop. I’ve been through the academy here in FL. They are trained to only use their weapon as a last resort and it is to shoot center mass, just like in the military. Center mass = a kill. (depending on the amount of shots taken center mass.)

      • I don’t even think he called back up. There is a vid on YouTube of the police dispatch from the day of the incident. I didn’t hear dispatch call for back up to his location. But officer on scene did ask dispatch to call a neighboring county for crowd control. Dispatcher even said that she did not know why they needed crowd control. Then calls from news reporters started coming in saying there was an officer involved shooting and crowd was forming.

        • He attempted to call for backup, according to his testimony. It wasn’t until he was on his way to the police station (before the hospital) after the incident that he realized his radio was on Channel 3, instead of Channel 1 (which is Ferguson’s channel).

          Take what you want from that, I’ve read a lot of the court docs and seem to be reading at least three different sequences of events that DW relayed to different investigators.

      • How can the police and prosecutor say that Wilsons call for backup wasn’t heard because his radio was on the wrong channel and yet he heard the store theft description of MB on the same wrong channel?
        There are so many of this type of differing stories, from both sides, that this should be in front of a judge and jury.

    • Stated is not the same thing as proven. The body was not near the car (where wilson said Brown was reaching through the window, across wilson, to his weapon strapped in his holster). 12 shots fired 7 hit, with some off them only being able have entered at the angles they did if he was already falling or fallen on the ground. None of the shots hit from point blank rang (as would be if struggling).

      • the thumb shot residue proves browns hand was inches away from the barrel his thumb had metal residue from the barrel that does not travel as far as gunpowder residue does .yes a tiny amt of metal residue leaves every gun everytime it is fired not just powder residue also there was ONLY 2 EYEWITNESSES both young black girls and both of their stories corroborate wilsons version with the exception of they thought/stated Wilson was pulling brown into the vehicle lets face it Wilson 6 ft tall 200 lbs brown 6ft5 in and 350 lbs there is no way anyone with any amt of intelligence would pull a man that much heavier and bigger than him into a car on top of himself and that alone is enough to prove brown was guilty of assault on a police officer if brown had any respect for the law and wasn’t such a smartass he would be alive but his parents never taught him proper respect or how to act so if anyone is to blame it is browns parents and brown himself not Wilson

        All three autopsy reports agree the first shot was in the car and it struck Michael Brown at very close range.
        Blood evidence in the car and on the officers uniform also support that

    • Rong he was in a struggle with the cop but after the first shot brown ran like anyone would do if someone shot at them cop or not the officer got out of his car ran after and shot legion you are wrong and your notpart of the 99%

    • The first round fired by this officer was when the CHILD was 35 feet from the officer, while he was still in his car, secondly, the second round fired entered the CHILDs back, indicating he was being shot before the officer touched him. By the time the officer had physical contact with the CHILD he had already shot him three times and then shot him twice afterward, in the head. If they were struggling in a fight, he wouldn’t have had so many rounds in his back and the officer would have received an injury of some kind. He received no injuries what so ever. This was murder. Uphold your oath piggy.

What’s a fact is he was sour beat the car with a bullet found into the back of his forearm and exciting the front.that can only happen with your hands up. plus the coroner said that the shots top the torso cam into the body from above Brown’s body. Which means that he was kneeling and in a surrendering position twice. Which means that his lie about a fight true which is why various cops Anna attorneys are fighting the verdict. It’s blatant fascism. Plus Wilson’s girl is a kkk member. Guilty by association, no. Birds of a feather, yes. the D.A was already proven top be in support of Wilson by donation top his defense fund. So how in the world would the trial be fair. There was far more than enough evidence and video evidence to get Wilson the chair.

    • The testimony of the officer was inconsistent (it did not add up), read the reports, before leaving a comment. The officer was unaware of the robbery, therefore, the whole reason for conforming him in the first place was a lie. It was excessive force used, shooting a person that many times as a individual meant to serve and protect is unacceptable no matter the color of the skin. The officer got trigger happy and killed a young boy. Many people have stolen and fought with an officer and are still living to this day. That confrontation should not have cost him his life. If the officer is more concern with himself (this is based in his comment that he was going home that day), he should not be a personnel that is to serve the public. I have brothers who are military personnel and their hearts are for this country, not themselves.

      • the whole reason Wilson confronted brown was because Wilson was leaving a domestic violence call when 2 idiots were walking down the middle of the road (illegal jaywalking) Wilson told them to get out of the road had brown(idiot)just gotten out of the road Wilson would have done nothing but drive past (Wilson did not get the robbery call)but instead idiot(brown) decided with his size and power he could do whatever the hell he wanted and confronted Wilson , in the

    • Except he wasn’t struggling because he was shot 150ft away from the officer. There was a scuffle inside the window of the cop car where witnesses claim the officer tried to pull him in the window after he hit them with the car door. After he got free he took off running and when he was 150 feet away the cop yelled to him he turned around to face the cop and before he could put his hands up the cop opened fire. The cop claims “he was going for a gun” tho he was unarmed

    • Not only that but he was shot in the top of the head and there were reports of him charging at the officer. If he was fleeing how was he shot in the top of the head?

        • This is not true. The most credible witness statements all agree he was moving toward the officer. There are difference in the reports on whether it was a fast walk or charge.
          All agree that his hands were never above his head.
          One witness stated he had his head down in a charging position as he got closer.

    • No, it was proven HE DID struggle and was shot in the hand then. Now go read the report and see he was shot more after the fact and pay close attention to his distance. You can then come back about how he charged the officer, and I will then come back with eyewitnesses that said he didn’t.   3. We were told this week that two wrongs make a right. Michael Brown was only 18 years old. He was no saint. He disobeyed a Police Officer. He struck a Police Officer. He broke the law and he should have been punished, not murdered. He should have been given a chance to reform himself through the proper channels of a justice system we’re supposed to trust. Instead, he was given a death sentence in the middle of the street. Michael will never see a day in court for his wrongs- and neither will Officer Darren Wilson for his.   4. Actually even the prosecutor said he was fleeing when the decision was announced. The question is, they never answered is why he turned back? Name one person who turns back and rushes an armed Officer who has already shot Mike several times? That doesn’t add up for me.

  5. It wasnt proven that he wasnt fleeing at any point during the case. But we know that a struggle had happened, and after the first few shots he ran away and was killed 150 feet away from the cop car not the 35 that they claimed. So its a valid article Legion, you should catch up on it

  9. Seriously, here are the undisputed facts. Mike brown was an 18yr. old felon with a criminal record as long as my arm. The day of events he committed a strong armed robbery – (a felony assault attacking a small Asian man while stealing cigars) Then, while feeling invincible he decided to attack a a white police officer. (Another felony) and to go for police mans gun is just like saying “Please kill me now.” Mike Brown was s thug that should never have been aloud to walk the streets. That police officer did society a favor that day.

  11. what you all fail to see is that brown was killed more then 100 feet away from the officers car with all shots in his front, so tell me if i die 100 feet away with 7 shots to my front how was i 1. that close to the officer, 2. fighting with the officer, and 3. able to get that few away being shot 7 times weighting over 300 pounds?, just think about all that for a second and mike brown did not rob that store the owner was on tv and stated that part himself so what was the real need to attack this man while being armed?….
