Did An 18 Year Old Girl Really Murder Homeless Man, Sever His Penis?

Las Vegas- Duran Bailey was your average homeless man. How he met his end on July 8, 2001, was far from average. His killer didn’t stop after hitting him over his head. The killer stabbed him. Slashed his throat. Knocked out his teeth. Severed his penis. Slashed his anus. Bailey’s skull was cracked, and his blood-caked eyes were swollen shut. Swabs taken from his penis and rectum would later be found to contain semen. The medical examiner found 30 injuries to his genitals and upper body. Bailey wasn’t just murdered, he was ruthlessly torn apart.

Bailey’s indignities didn’t end with his death. After the killer finished with his body, that person buried him in the refuse from the Flamingo Road dumpster.

His killer fled from there. The Police claim it was to Panaca. That’s where they arrested 18-year-old Kirstin Blaise Lobato more than 10 days after the crime. They based their investigation on hear-say, rather than hard evidence found at the scene; as the man was homeless, not much was done to figure out who had committed the crime until a person called them, claiming that Lobato had said to a mutual acquaintance that she had cut off a man’s penis.

She had admitted to a number of her friends that she had cut a man, who was attempting to rape her, around the groin area, but it is uncertain if this person was Bailey. Nor had she done these horrific acts to Bailey. It should be noted that the semen found on Bailey’s person could not have come from Lobato. Also, the attack she had admitted to apparently had taken place weeks before Bailey’s death, at a completely different location in Las Vegas.

Lobato’s supporters, who have followed the case from day one, say prosecutors got the wrong person. While Lobato languished in jail, Bailey’s killer was allowed to wander free, committing other crimes. They think the only way to free their friend may be to find the real murderer. I wonder if these teens would care to get into a van with a raspy-voiced dog and do some of their own sleuthing.

To that end, they recruited the Innocence Project, an organization that has freed hundreds of wrongly convicted prisoners. The group has offered to underwrite DNA testing in the Lobato case. Kirstin’s supporters hope some piece of cellular detritus, a scrap of a genetic fingerprint, will blow the old case wide open again.

This is not meant to be, however, as the district attorney’s office, District Court and state Supreme Court have blocked their offers to test the DNA evidence. A petition on Change.org urging the DA to allow testing has garnered more than 125,000 virtual signatures. But the office hasn’t budged.

“DNA testing is not going to exonerate her because she confessed,” said Steve Owens, chief deputy district attorney. “There are hundreds of profiles that could be pulled off the body because it was found in a dumpster. People will be chasing after a lot of red herrings.” At the same time, one wonders why this “confession” was not taken in the proper context, in that she had also stated that she had been under attack. She was also most likely attacked by some other person, at some other time and at some other place. Also, where did that semen come from? If the police are unwilling to conduct a DNA test, it would seem that it is simply to prevent their incompetence from being revealed. At the cost of an innocent woman’s life.
